1. Acceptance of Terms & Conditions
Welcome to Titan Sports Bets, operated by BETMGM, LLC ("Operator", "we", "us", or "our"). By accessing, registering for, downloading the mobile application, or using the sports betting platform (collectively, the "Services"), you ("User", "Patron", or "you") expressly agree to be bound by these exhaustive Terms of Service ("Terms"). If you do not agree to every provision contained herein, you are strictly prohibited from utilizing the Services. These Terms constitute a legally binding agreement.
2. Eligibility & Strict Geolocation Requirements
To establish an account and place real-money wagers, you must satisfy the following stringent criteria:
- Age Requirement: You must be at least twenty-one (21) years of age. Underage gambling is a criminal offense.
- Physical Presence: You must be physically located within the geographic boundaries of a specific authorized jurisdiction (CO, IL, KS, MA, MO, NC, TN, WY) at the exact moment you place a wager.
- Geolocation Monitoring: We utilize advanced third-party geolocation services (e.g., GeoComply) to continuously monitor and verify your physical location. By using the app, you grant explicit consent for this continuous tracking.
- Prohibited Software: The use of Virtual Private Networks (VPNs), proxies, location-spoofing software, or remote desktop applications to bypass our geolocation protocols is strictly prohibited, constitutes fraud, and will result in immediate account termination and potential reporting to law enforcement.
- Exclusion Lists: You must not be present on any state or operator voluntary or involuntary self-exclusion list.
3. Account Registration & KYC/AML Verification
Pursuant to federal Anti-Money Laundering (AML) laws and state gaming regulations, we must rigorously verify the identity of every patron. Upon registration, you are legally required to provide accurate, current, and complete information, including:
- Full legal name, matching your government-issued ID.
- Current residential address (P.O. Boxes are not accepted).
- Date of Birth.
- The last four digits of your Social Security Number (SSN). In instances of large winnings or manual verification failure, the full SSN will be required.
We reserve the right to utilize third-party credit reporting agencies and identity verification databases to corroborate your information. Providing false information is a violation of state laws and will result in account confiscation.
4. Account Funding, Deposits, and Withdrawals
All funds deposited into your account are held in a segregated bank account entirely separate from our corporate operating funds, guaranteeing player fund liquidity.
- Deposits: You may only deposit funds using payment methods registered in your own legal name. Use of corporate cards or third-party payment methods is strictly prohibited.
- Withdrawals: We reserve the right to mandate that withdrawals be processed back to the original method of deposit. All withdrawal requests are subject to internal security audits which may take up to 72 hours.
- Chargebacks: Any unjustified chargebacks will result in immediate account suspension, and we reserve the right to pursue civil and criminal legal action to recover funds.
5. Placing Wagers & Settlement Rules
All wagers placed are final once accepted by our servers. We do not accept requests to cancel or void wagers mistakenly placed by the user. Operator reserves the right to refuse, restrict, or limit any wager at our sole discretion. In the event of an obvious line error (palpable error) resulting from technical malfunction or human error, we reserve the right to void the wager and return the original stake.
6. Dormant & Inactive Accounts
If you do not log in to your account for a continuous period of twelve (12) months, your account will be deemed "Dormant." We reserve the right to charge a monthly inactivity fee of $5.00 (or the maximum allowed by state law) deducted from your cash balance until the balance reaches zero. If your account remains dormant for the statutory period defined by your state (typically 3 to 5 years), remaining funds will be remitted to the state as unclaimed property.
7. Intellectual Property Rights
All content, software, graphics, logos, algorithms, and odds data comprising the Services are the exclusive intellectual property of the Operator or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial entertainment purposes. Scraping odds data or reverse-engineering our software is strictly prohibited.
8. Tax Reporting and Liability
You are solely and fully responsible for declaring, reporting, and paying any applicable state, local, or federal taxes derived from your winnings. Operator complies with all IRS reporting mandates. An IRS Form W-2G will be generated and reported to the IRS for any wager resulting in winnings of $600 or more (provided the payout is at least 300 times the original stake).
9. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICES. You agree to indemnify and hold harmless the Operator, its parent companies, affiliates, and employees from any claims arising from your breach of these Terms.
10. Dispute Resolution & Binding Arbitration
Any disputes or claims arising out of your use of the Services that cannot be resolved through our internal customer service shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA). YOU EXPLICITLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
